TERMS & CONDITIONS OF PARTICIPATION

By registering for, attending, or participating in any golf clinic organised by Well Out Pro (“the Organiser”), you (“the Participant”) agree to be bound by the following Terms and Conditions.

1. Eligibility & Participation

1.1 These golf clinics are designed for absolute beginners unless otherwise stated.

1.2 Participants must be 18 years and above, or minors must be accompanied by a parent or legal guardian who consents on their behalf.

1.3 The Organiser reserves the right to refuse participation to any individual who fails to comply with these Terms & Conditions or venue rules.

2. Venue Rules & Private Members’ Clubs

2.1 Many clinics are held at private members’ golf clubs, including but not limited to Limuru Country Club.

2.2 By participating, the Participant agrees to comply fully with:

• The club’s rules, by-laws, dress codes, etiquette, and conduct requirements

• Instructions issued by club management, golf professionals, marshals, or security personnel

2.3 The Organiser shall not be liable for any penalties, removal, suspension, or disciplinary action imposed by the host club due to a Participant’s conduct.

3. Assumption of Risk

3.1 Golf is a physical activity that carries inherent risks, including but not limited to:

• Minor or serious injury

• Accidental contact with golf clubs or balls

• Slips, falls, or strains

3.2 The Participant voluntarily assumes all risks associated with participation and confirms they are medically fit to take part.

4. Liability & Indemnity

4.1 To the fullest extent permitted under Kenyan law, the Participant releases and indemnifies Well Out Pro, its directors, employees, contractors, golf professionals, and venue partners from any claims, losses, injuries, damages, or liabilities arising from participation, except where caused by gross negligence or wilful misconduct.

4.2 The Organiser shall not be responsible for:

• Loss or damage to personal property

• Injuries caused by third parties

• Actions or omissions of the host club
  
  

5. Fees, Cancellations & Refunds

5.1 All fees paid are non-refundable, unless otherwise stated in writing by the Organiser.

5.2 The Organiser reserves the right to:

• Reschedule a clinic due to weather, venue availability, or unforeseen circumstances

• Offer a replacement date or credit at its discretion
  
  

6. Code of Conduct

6.1 Participants must conduct themselves respectfully towards:

• Coaches and instructors

• Club members and staff

• Fellow participants

6.2 The Organiser reserves the right to remove any participant without refund for:

• Disruptive, unsafe, or inappropriate behaviour

• Failure to follow instructions or venue rules
  
  

7. Media Consent & Intellectual Property

7.1 By participating, the Participant irrevocably grants consent to Well Out Pro to:

• Take photographs, audio recordings, and video footage of them during the clinics

• Use, reproduce, edit, publish, and distribute such content for marketing, promotional, educational, and commercial purposes

7.2 This consent applies across all platforms, including but not limited to:

• Social media

• Websites

• Advertising materials

• Presentations and digital content

7.3 The Participant waives any right to:

• Inspect or approve the final content

• Claim compensation or royalties arising from its use
  
  

8. Data Protection

8.1 Personal data collected shall be handled in accordance with the Kenya Data Protection Act, 2019.

8.2 Information will be used for registration, communication, marketing, and operational purposes only.

9. Amendments

9.1 Well Out Pro reserves the right to amend these Terms & Conditions at any time.

9.2 Updated versions will be communicated via the registration platform or official communication channels

10. Governing Law & Jurisdiction

10.1 These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Republic of Kenya.

10.2 Any disputes shall be subject to the exclusive jurisdiction of the Kenyan courts.

11. Acceptance

By registering for or attending a Well Out Pro golf clinic, the Participant confirms that they have read, understood, and agreed to these Terms & Conditions in full.
